The Ministry of Justice has changed the procedure for filing applications in electronic form

04/01/2020 The Ministry of Justice of Ukraine adopted Order No. 1307/5 “On Amendments to the Procedure for State Registration of Legal Entities, Individuals – Entrepreneurs and Public Associations that Do Not Have the Status of a Legal Entity”.

The order introduced changes to the procedure for conducting state registration upon an application in electronic form. You can apply without leaving your home, which is extremely important during the quarantine period.

The following changes have been made by order:

  • An application in electronic form is submitted subject to signing by the applicant using electronic identification tools, and subject to payment for state registration services in full.
  • The application and documents for state registration in electronic form must comply with the requirements established by the Law of Ukraine “On Electronic Documents and Electronic Document Management” and “On Electronic Trust Services”.

In case of state registration in electronic form, the original documents provided by law are attached to the application. Payment for the provision of administrative services is also carried out via the Internet, using payment systems or software tools of the Unified State Portal of Electronic Services.

An application in electronic form is registered in the Unified State Register, and based on the results of registration of the application, the applicant is provided with an access code to the results of consideration of the relevant documents.

Registration of applications in electronic form is carried out in the order of their receipt, including taking into account applications submitted in paper form.

The moment of acceptance of the application and documents for state registration in electronic form is the date and time of registration of the application in the Unified State Register.

If, in accordance with the law, state registration requires the submission of a notarized document and / or a document confirming the registration of a legal entity – non-resident in the country of its location, and / or a notarized copy of a document certifying a person who is the ultimate beneficial owner of a legal entity, the application shall be accompanied by electronic copies of such documents made by scanning with the application of a qualified electronic signature of the applicant.

Thus, this order excluded the rule according to which documents for state registration of changes to information about a legal entity contained in the Unified State Register in connection with a change in the head of a legal entity, the size of the authorized (compound) capital (share fund) or the size of a part of each of the founders (participants), as well as other cases provided for by laws, were submitted exclusively in paper form
